You can apply for an extension of your stay while your current temporary resident status is still valid. Application must be made at least 30 days before your current status expires.Â
Note that the validity of your work permit will not exceed the validity of your passport. Make certain that your passport remains valid for the same duration as your required extension.
A different application for extension of temporary resident status is not necessary. When you apply for a work permit, the officer will provide all necessary documentation with one application.Â
Application for Family Members to Extend Conditions of Work Permit
Members of your family such as spouse or dependent children, who wish to remain longer, study or work in Canada must apply for clearance to do so. Instead of submitting separate application forms for each person, you can fill one form and include the details of you and your immediate family. Each person’s appropriate documentation and fees must also be included.
You may wish to extend your work permit or change employers if you are currently working in Canada. You may also be a temporary resident who wishes to work. However, before you start working, you must obtain a work permit.
Work permits are obtained from outside of Canada but in a few situations, an initial work permit can be applied for within Canada.Â
If you disregard one of the conditions of your permit, or your status has expired, it constitutes an offence under the Immigration and Refugee Protection Act. If you have also worked without a permit where it is required, you may be subject to an admissibility hearing that could lead to removal from Canada. In such cases, do not apply for an extension as you are illegible.
Determining Eligibility
To be able to continue to reside in Canada after your temporary resident status has expired, you may apply for restoration of status within 90 days of your permit expiry date or leave Canada.
It is important to note that it is illegal to remain in Canada beyond the validity of your status in Canada. You are also not required to work without a required work permit. Likewise, it is illegal to study without a study permit.
If you are eligible to apply, then follow these steps to apply for extension of your Canadian work permit:
